Confirmation of Order 2022 - Diversion (in part) of Footpath 104 at Orsett Showground
The effect of the Order as confirmed is to divert Footpath 104 (in part) from a position along existing Footpath 104 at TQ56426, 181602 following in a general easterly direction for 113m to TQ564936, 181636 then in a general southerly direction for 72m to TQ564959, 181568, as shown on the map, for a width of 2m.
A copy of the Order and map has been placed and may be seen on Thurrock Council's website thurrock.gov.uk/publicnotices and at the Civic Offices, New Road, Grays SS17 6SL by appointment between 9am and 5pm, Monday to Friday. An appointment can be made by emailing prow@thurrock.gov.uk or by phoning 01375 366 100, where copies of the Order and map can be made available.
Any person who wishes to claim compensation under section 28 of the Highways Act 1980 for depreciation or damage for disturbance arising as a result of the Order coming into force must make a claim in writing to prow@thurrock.gov.uk or addressed to the Public Rights Of Way Officer, Highways Department, Thurrock Council, Civic Offices, New Road, Grays, RM17 6SL, and serve it by delivering it at, or sending it by prepaid post, to that address no later than 24 November 2022.
The Order comes into force on 13 October 2022 but a person aggrieved by the Order, who wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act as amended, or any regulation under the Act has not been complied with in relation with the Order, he or she may under paragraph 2 of schedule 2 to the Act as applied by paragraph 5 of schedule 6 to the Act, within 6 weeks from 13 October 2022 make an application to the High Court.
