Notice of Making an Order
Public Path Diversion Order 2022

To divert (in part) Public Footpath 104, Orsett Showground, Rectory Road, Orsett.

The above Order, made on 8 June 2022, under section 119 of the Highways Act 1980, will divert in part public Footpath 104 at Orsett Showground Rectory Road Orsett.

The details of this Order can be viewed below. A copy of the Order together with the plan will be available for inspection by appointment for a period of 28 days at the Civic Offices, New Road, Grays, RM17 6SL, during normal office hours between 9am to 5pm Monday to Friday. Appointments can be made by emailing prow@thurrock.gov.uk or by phoning 01375 366 100.

Any representations about or objections to the order must be made in writing, giving the grounds on which it is made and sent via email to prow@thurrock.gov.uk or to the address above to arrive on or before Thursday 8th September 2022. Any objection may be communicated to other persons who may be affected.

If no such representations are duly made, or if any so made are withdrawn, Thurrock Council may confirm the Order as an unopposed Order. If the Order is sent to the Secretary of State for the Environment for confirmation any representations and objections which have not been withdrawn will be sent with the Order.

Diversion (in part) of Footpath 104 at Orsett Showground

This Order is made by Thurrock Council ("the authority") under section 119 of the Highways Act 1980 ("the 1980 Act") because it appears to the authority that in the interests of the landowner of the land crossed by the footpath described in paragraph 1 of this Order it is expedient that the path should be diverted.

Orsett Showground Limited has agreed to contribute towards any expenses which are incurred to bringing the new site of the path into a fit condition for use by the public.

Thurrock Council has consented to the making of the Order as required by section 120 (2) of the 1980 Act.

By this order:

1. The public right of way over the land situated at Orsett Showground and shown by a bold continuous line on the map contained in this Order and described in (part 1) of the schedule to this Order shall be stopped up after 42 days from the date of confirmation of this Order.

2. Where immediately before this Order there is apparatus under, in, on, over, along or across footpath 104 belonging to statutory undertakers for the purpose of carrying on their undertaking, those undertakers shall continue to have the same rights in respect of that apparatus over the land referred to in paragraph 1 namely: Orsett Show Ground.

3. There shall be at the end of 42 days from the date of the confirmed of this Order be a public footpath over the land situate at Orsett Showground described in (Part 2) of the schedule and shown by a broken line on the map contained in this Order.

Schedule Part 1 – Description of site of existing path or way

From a position along existing Footpath 104 from TQ564826, 181602 for a length of 136m in a south easterly direction to TQ564959, 181568 and indicated on the map as A-C by a solid black line.

Schedule Part 2 – Description of site of new path or way

At a width of 2m, from a position along existing Footpath 104 at TQ56426, 181602 following in a general easterly direction for 113m to TQ564936, 181636 then in a general southerly direction for 72m to TQ564959, 181568 as indicated on the map as A-B and B-C and marked on the plan as a dotted black line.
